Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and HireA.Tech, LLC (“HireA.Tech,” “we,” “us,” or “our”), a Tennessee limited liability company that operates an automated lead-brokerage marketplace connecting consumers seeking home-service work (“Customers”) with independent local trade professionals (“Pros”). They govern your use of our website, telephone line, text messaging, and related services (together, the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What HireA.Tech is — and is not
HireA.Tech is a lead-brokerage marketplace and a venue for introductions. We are not a contractor, home-services provider, or employer of any Pro; we do not perform, supervise, schedule, price, or inspect any work; and we are not a party to any agreement between a Customer and a Pro. We do not guarantee the availability, licensing, insurance, quality, safety, timeliness, pricing, or outcome of any work performed by a Pro. Any reference to a Pro as “vetted,” “trusted,” or similar reflects our sourcing criteria only and is not a warranty.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of a business, you represent that you are authorized to bind that business to these Terms.
3. Terms for Customers
- Using the Service to request a connection to a Pro is free to Customers.
- When you submit a request, we share the details necessary to fulfill it (such as your name, phone number, service ZIP code, and a description of your issue) with the Pro we connect you to so they can contact you.
- You are solely responsible for evaluating, vetting, contracting with, and paying the Pro. Any agreement, payment, warranty, or dispute regarding the actual work is solely between you and the Pro.
- You agree to provide accurate information and to use the Service only for genuine service requests.
4. Terms for Pros
If you register as a Pro, the following additional terms apply to you:
- Standard leads. We may offer you exclusive leads in your selected trades and service area. For a standard lead, you pay the per-lead fee only when you affirmatively accept the lead (for example, by replying to an offer or tapping the accept link). An accepted lead is exclusive to you.
- After-hours emergency leads (on-demand). If you opt into the after-hours emergency rotation, you must separately accept our After-Hours Emergency & On-Demand Pricing Agreement. For a live emergency call we route to you, answering the call is how you accept the lead: if you pick up a connected emergency call, you have accepted that lead and agree to be charged the on-demand per-lead rate then in effect, which is higher than the standard lead rate. If you cannot take the job, do not answer, and we will route to the next Pro. Opting into the rotation and accepting the on-demand rate are a single, inseparable agreement.
- Credits and charges. Lead fees may be satisfied by prepaid lead credits or charged to your payment method. Fees are earned when a lead is accepted and, except as required by law or expressly stated, are non-refundable. Promotional or trial credits may expire as disclosed at the time of grant.
- Your independent business. You represent and warrant that you hold and will maintain all licenses, registrations, permits, and insurance required to perform your trade in your service area, and that you will perform all work in a safe, lawful, and workmanlike manner. You set your own prices to the Customer, schedule, and scope of work.
- Messaging consent. You will only be sent text messages if you have provided SMS consent, and you may opt out at any time as described in our SMS Terms.
- Independent contractor relationship. Pros are independent businesses. Nothing in these Terms creates an employment, agency, partnership, joint venture, or franchise relationship with HireA.Tech.
5. Acceptable use
You agree not to: submit false, misleading, or fraudulent information; use the Service for any unlawful purpose; circumvent fees or our routing; harvest or scrape data; interfere with or disrupt the Service; or infringe the rights of others. We may suspend or terminate access for any violation of these Terms.
6. Intellectual property
The Service, including its content, software, and trademarks, is owned by HireA.Tech or its licensors and is protected by law. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose. All rights not expressly granted are reserved.
7. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY PRO OR CUSTOMER WILL MEET YOUR EXPECTATIONS.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HIREA.TECH WILL NOT BE LIABLE FOR THE ACTS, OMISSIONS, WORK, CONDUCT, OR DISPUTES OF ANY PRO OR CUSTOMER, OR FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
9. Indemnification
You agree to indemnify and hold harmless HireA.Tech and its members, officers, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or — for Pros — any work you perform or fail to perform for a Customer.
10. Dispute resolution & governing law
These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state and federal courts located in Gibson County, Tennessee, and you consent to the personal jurisdiction of those courts. Nothing in this section limits either party's ability to seek injunctive relief.
11. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Material changes will be highlighted where practicable. Your continued use of the Service after an update constitutes acceptance of the revised Terms.
